03 — Questions

Which Santa Clara County cities charge a city transfer tax?
Among the cities Diana serves, San Jose, Mountain View and Palo Alto charge their own transfer tax on top of the county's $1.10 per $1,000. Cupertino, Sunnyvale, Santa Clara, Los Altos, Saratoga, Campbell, Los Gatos and Milpitas don't.
Who pays the transfer tax when I sell?
In Santa Clara County, the seller customarily pays the county tax, and city transfer taxes are commonly split between buyer and seller. Your purchase contract decides, so confirm with your escrow officer.
Why doesn't the calculator fill in commission or escrow fees?
Agent compensation is negotiated, not set by law, and escrow and title fees vary by company and price. Enter the numbers from your listing agreement and your escrow officer's estimate for the most accurate result.
Does the estimate include capital gains tax?
No. It shows your net before income taxes. If the home was your main residence for two of the last five years, you may exclude up to $250,000 of gain ($500,000 for married couples filing jointly). Talk with a CPA about the rest.
